We provide automated assistance for contesting traffic infractions via Trial by Written Declaration. - Case Context & Evidence: We collect information you provide during the interview process, including weather conditions, traffic density, and your narrative of events. We also collect files you upload, such as photographs and diagrams.
- Payment Information: While we do not store full credit card numbers, we collect payment status and transaction history associated with your orders.
B. Information Collected Automatically
- Uploaded Documents (OCR): When you upload photos of your ticket or license, our system uses Optical Character Recognition (OCR) to parse and store the text data contained within those images.
- Device and Usage Data: We collect standard web log data, including IP addresses, browser types, pages visited, and time spent on pages to ensure the security and proper function of our application.
- Cookies and Similar Technologies: We use cookies and similar tracking technologies to maintain your session and improve your experience. See Section 5 for more details.
3 How We Use Your Information
We use the collected information for the following business purposes:
- Service Delivery: To dynamically generate the Request for Trial by Written Declaration (Form TR-205) and Attached Declaration (Form MC-031) populated with your "Statement of Facts".
- AI-Assisted Document Generation: To use artificial intelligence to analyze your case details and generate personalized defense arguments based on the information you provide.
- Eligibility Screening: To verify if your violation code qualifies for a Trial by Written Declaration under California Vehicle Code (CVC) § 40902.
- Transaction Processing: To process your one-time service fee payments via our third-party payment processor.
- Communication: To send you status updates via your dashboard or email (e.g., "Your defense package is ready for download").
- Analytics: To understand how users interact with our Platform and improve our services.

4 Use of Artificial Intelligence
Our Platform uses artificial intelligence (AI) technology provided by third-party services to assist in generating your Statement of Facts and defense documents. Specifically:
- AI Processing: The information you provide about your case (violation details, circumstances, and your narrative) is processed by AI systems to generate personalized defense arguments.
- Data Shared with AI Providers: Case-specific information (not including payment data or passwords) may be transmitted to our AI service provider for processing.
- No Automated Decision-Making: AI is used to assist in document generation only. All final documents are provided to you for review, and you make all decisions about whether to submit them to the court.
- Human Review: You are responsible for reviewing all AI-generated content before use.
5 Cookies and Tracking Technologies
We use cookies and similar technologies to operate and improve our Platform:
A. Essential Cookies
These cookies are necessary for the Platform to function properly. They enable core functionality such as security, session management, and remembering your login status.
B. Analytics Cookies
We use Google Analytics to understand how visitors interact with our Platform. Google Analytics collects information such as pages visited, time spent on pages, and general geographic location. - Analytics: We share anonymized usage data with Google Analytics to understand how users interact with our Platform.
- Error Monitoring: We use Sentry, an error tracking service, to monitor and fix technical issues. When an error occurs, Sentry may receive technical data such as request URLs, browser information, and device data to help us diagnose problems.
- Legal Obligations: We may disclose information if required to do so by law or in response to valid requests by public authorities.
- Court Filing (User Initiated): You understand that the final documents generated by Drivers Confidence are intended to be mailed by you to the Traffic Court, at which point they become part of the judicial record.
7 Data Security
We implement "reasonable security procedures and practices" to protect your Personal Information as required by the CCPA. Our security measures include:
- Encryption at Rest: Sensitive data, such as driver's license numbers, are encrypted in our database using AES-256 encryption.
- Encryption in Transit: All data transmitted between your browser and our servers is protected via HTTPS/TLS 1.3 encryption.
- Secure Authentication: Passwords are securely hashed using industry-standard algorithms (bcrypt).

Data Isolation for Law Firm Clients
For attorneys and law firms using our platform to serve their clients, we implement additional security measures:
- Database-Per-Tenant Architecture: Each law firm's data is stored in a completely separate database instance. Your firm's client information is never stored in shared tables with other firms' data, eliminating cross-contamination risks.
- Firm-Level Access Controls: Only the authorized attorney and their designated staff can access cases associated with their firm. Clients can only view their own cases.
- Isolated File Storage: Uploaded evidence, generated documents, and communication logs are stored in firm-specific directories with no shared access.
- Audit Logging: All case activities, document generation, and approvals are logged for compliance and accountability purposes.
8 Data Retention
We retain your personal information according to the following schedule:
- Active Accounts: Your data is retained while your account remains active.
- After Account Deletion: Upon account deletion request, we will delete or anonymize your personal information within 45 days, except as required for legal compliance.
- Generated Documents: Defense packages and case files may be retained for up to 3 years after generation for legal compliance and dispute resolution purposes.
- Payment Records: Transaction records are retained for 7 years as required by tax and financial regulations.
9 Your Rights Under the CCPA

A. Right to Know and Access

Our Service is intended for licensed drivers and individuals at least 18 years of age. We do not knowingly collect personal information from anyone under the age of 18. If we learn that we have collected personal information from a minor, we will delete that information promptly.
